SEC Cracks Down on Unlicensed Investment Schemes: Nyak-City Hostels Shut Down - Ghana

The Securities and Exchange Commission (SEC) has taken decisive action against Nyak-City Hostels Limited, shutting down the company for operating an unlicensed investment scheme. Incorporated in 2025, the entity was offering a product termed “Treasury Hostel Investment,” which it marketed as a superior alternative to treasury bonds, promising guaranteed lifetime returns over a 60-year period. This move underscores the SEC’s commitment to sanitising the investment sector and bolstering confidence in Ghana’s financial industry.

Mensah Thompson, Deputy Director General of the SEC, stated during the shutdown that the Commission is adopting a proactive stance, moving to intervene before investors suffer financial losses. “We take action. We can’t wait for the risk to happen for people to lose money before we take action. We are saying that the SEC is no longer going to sit back anymore,” Thompson declared. The SEC acted swiftly upon receiving intelligence regarding the company’s operations, aiming to prevent potential investor harm. Thompson elaborated, “Once we receive intel, we move straight, shut the place down. If we need to arrest, we arrest. If we need to prosecute, we prosecute.”

A significant concern for the SEC is the trend of businesses leveraging real estate ventures to offer investment services without the requisite regulatory approval. The 60-year tenure of Nyak-City Hostels’ investment product, without proper authorisation, is seen as a direct threat to the gradually returning confidence in Ghana’s financial market. “These are the people who siphon away confidence from our market, and we need to work together so that we can protect the confidence that is gradually coming back into our financial sector and our economy,” Thompson emphasised.

The SEC reiterates that all investment products offered to the public must undergo rigorous licensing, vetting, and scrutiny by the regulator to ensure adequate investor protection. Licensed products also provide established regulatory and resolution mechanisms that can be activated in the event of issues. “People can invest safely in regularized products, licensed products that have been vetted, scrutinised and approved by the regulator to be offered to the public, so that tomorrow, if something goes wrong, there are resolution mechanisms that we can take them through,” Thompson explained.

While Nyak-City Hostels Limited representatives have been invited for discussions, the SEC’s initial action has been to shut down the facility. This is considered a lenient approach, with the possibility of further enforcement, including arrests and prosecution, depending on the ongoing discussions and the company’s response. The SEC has affirmed its continued commitment to combating unlicensed investment operators to safeguard investors and maintain the integrity of Ghana’s financial sector.
