SERAP Sues Code of Conduct Bureau Over Alleged Failure to Probe Lawmakers on Electoral Act, Tax Reforms

The Socio‑Economic Rights and Accountability Project (SERAP) has instituted proceedings against the Code of Conduct Bureau (CCB) at the Federal High Court, Abuja, over the Bureau’s alleged failure to investigate claims of abuse of office in the legislative process surrounding amendments to the Electoral Act and tax reform laws.

The suit, marked FHC/ABJ/CS/634/2026, seeks an order of mandamus compelling the CCB to probe allegations that certain lawmakers improperly removed provisions on electronic transmission of election results from the Electoral Act (Amendment) Bill. SERAP also requests an investigation into claims that aspects of tax reform bills were unlawfully altered by lawmakers and executive officials, resulting in discrepancies between the versions passed by the National Assembly and those later gazetted.

In a statement signed by Deputy Director Kolawole Oluwadare, SERAP emphasized that the reliefs sought would address concerns of conflict of interest, abuse of office, and non‑disclosure of interests, while reinforcing adherence to due process. The organisation urged that any established violations be referred to the Code of Conduct Tribunal for prosecution.

SERAP argued that lawmaking influenced by personal or sectional interests undermines constitutional responsibility, stressing that public officers hold office in trust for the people and must not deploy official power for private advantage. It cited constitutional provisions mandating transparency, accountability, and anti‑corruption measures in governance.
