The Lagos State Government has issued a stern warning to businesses across the metropolis, declaring that policies such as “No Return, No Refund, No Replacement” and “No Cancellation After Payment” are legally unenforceable and cannot supersede the fundamental rights of consumers. This directive underscores the state’s commitment to fostering a fair and transparent marketplace.
The Lagos State Consumer Protection Agency (LASCOPA) has been at the forefront of this initiative, with its General Manager and Chief Executive Officer, Afolabi Solebo, articulating the agency’s stance. While acknowledging businesses’ prerogative to establish reasonable terms and conditions, Solebo emphasised that these must not infringe upon consumers’ legal entitlements, particularly when goods are defective, unsafe, misrepresented, or unfit for the purpose communicated to the seller prior to purchase.
According to Solebo, consumers are legally entitled to appropriate remedies, including refunds, replacements, or repairs, when faced with substandard goods or services. Any business policy designed to circumvent these rights is deemed unfair, misleading, and void. LASCOPA is actively collaborating with consumers to eradicate such predatory trade practices, urging businesses to operate with integrity and accountability.
The agency’s directive extends to various sectors, including event centres, hotels, and reservation service providers, encouraging them to adopt transparent and consumer-friendly policies. This proactive approach aims to build greater trust and confidence within the Lagos marketplace, aligning with the state government’s broader vision for sustainable economic growth.
Consumers are advised to exercise due diligence by inspecting goods before purchase, retaining all proof of payment, and promptly reporting any instances of unfair trade practices or denial of their legitimate rights to LASCOPA. The agency has reiterated its commitment to enforcing all relevant laws and regulations to safeguard consumer welfare and promote a competitive business environment where both consumers and businesses can thrive. Residents are encouraged to engage with LASCOPA by submitting complaints and enquiries to its office in Ikeja, Lagos, via email or designated phone lines for swift intervention.
