The Use of Autonomous Weapons in Armed Conflict

Abstract

In man’s continual attempts to more conveniently wage war, the use of unmanned aerial vehicles and other forms of lethal autonomous weapons loom in the horizon. These weapons are not currently addressed in international law. However, based on the existing principles of international law, the legality of the use of such weapons may be examined. It is against this background that this article examines lethal autonomous weapons, the current use of such weapons, the requirements that must be fulfilled before they are used and the compatibility of such weapons with the existing law on armed conflict. Particular attention is given to the international humanitarian law principles of distinction and proportionality, and the capability of such lethal autonomous weapons to comply with the principles. Furthermore, the attribution and accountability gaps created by autonomous weapons is highlighted.
