A significant shift in consumer protection for electronic devices is underway in Kenya, as the Communications Authority of Kenya (CA) has introduced new regulations mandating a minimum one-year warranty for all phones, laptops, smart TVs, tablets, and commercial networking equipment sold within the country. This regulatory overhaul, detailed in the new Communication Equipment Vendor Class Licence, also imposes mandatory return policies, bolstering safeguards for consumers acquiring these essential communication tools.

Previously, vendors operated without a legal obligation to offer warranties or establish return policies. This left consumers vulnerable to substantial repair costs for products that developed faults shortly after purchase. The CA’s directive explicitly states, “Ensure that all electronic communications equipment it sells in the Kenyan market shall have at a minimum, a warranty period of one (1) year with a return policy.” This move is poised to reshape vendor practices and enhance buyer confidence across the sector.

Beyond warranty provisions, the regulations address the burgeoning online retail space. Vendors operating e-commerce platforms are now required to furnish customers with verifiable physical addresses, email addresses, and phone numbers. This ensures accessibility for after-sales support and facilitates consumer recourse. Furthermore, all sales, whether conducted through physical stores or online channels, must be accompanied by official receipts. These receipts are mandated to include crucial details such as the seller’s name, product model, serial number, and the stipulated warranty period, providing a clear record for both parties.

The CA’s new rules also extend to the resale of refurbished devices. To prevent consumer deception, sellers must now clearly and permanently label such products as “Refurbished.” This stringent requirement aims to ensure that buyers are fully informed about the condition of the goods they are purchasing, thereby promoting transparency in the market for pre-owned electronics. The regulations also stipulate that vendors must “Provide customer support services to assist any person to whom it has sold electronic communications equipment and to answer questions regarding products, services and any other reasonable related questions.”
