The Supreme Court of Nigeria has definitively settled a protracted legal dispute over the crude oil aboard the FPSO Tamara Tokoni, ordering its immediate handover to General Hydrocarbons Limited (GHL). This landmark ruling by the apex court effectively nullifies previous judgments by lower courts, asserting clear jurisdictional boundaries and concluding the ownership and control contest.

In a unanimous decision delivered by a five-member panel of justices on Friday, the Supreme Court held that the suit initiated by First Bank of Nigeria (FBN) was fundamentally contractual in nature. Consequently, the court determined that neither the Federal High Court nor the Court of Appeal possessed the requisite admiralty jurisdiction to adjudicate the matter. This finding underscores the critical importance of correctly identifying the nature of a dispute for jurisdictional purposes, a key consideration for legal practitioners and corporate counsel.

The Supreme Court’s judgment, which allowed the appeal filed by General Hydrocarbons Limited, explicitly set aside the Court of Appeal’s decision, characterising it as “perverse.” The ruling further mandates the Chief Registrar of the Court of Appeal and the Admiralty Marshal to promptly comply with the apex court’s directive by releasing the crude oil to General Hydrocarbons Limited. Justice Abiru delivered the lead judgment, with Justices Uwani Aba-Aji, Salawa, Agim, and Uwa concurring, reinforcing the consensus at the nation’s highest judicial level.
