Nigeria Secures $6.2 Million Arbitration Victory Against European Dynamics UK Ltd
Nigeria has recorded another significant arbitration triumph, saving the country from potential financial exposure of $6.2 million (₦9.3 billion).
The award, delivered on February 3, 2026 by Mrs. Funmi Roberts, sitting as Sole Arbitrator at the International Centre for Arbitration and Mediation, Abuja, dismissed all claims brought by European Dynamics UK Ltd against the Bureau of Public Procurement (BPP).
European Dynamics had alleged breach of contract in the execution of a World Bank‑financed national e‑Procurement project, seeking $2.4 million for milestone completions, $3 million in damages, and $800,000 in settlement claims. Central to the dispute was the User Acceptance Test (UAT), which revealed critical deficiencies in the system delivered by the contractor.
The tribunal upheld Nigeria’s position that software delivery crystallises only upon successful UAT, and that deficiencies must be remedied at no additional cost. It further ruled that the contractor bore full responsibility for ensuring compliance with contractual requirements, rejecting claims of merged project phases and dismissing all demands in their entirety.
The Attorney‑General of the Federation (AGF), Prince Lateef Fagbemi, SAN, commended the BPP Director‑General, Dr. Adebowale Adedokun, and the Nigerian legal team led by Johnson & Wilner LLP with Basil Udotai Esq., for their expertise and resilience. He noted that the victory sends a strong message to the international community that Nigeria will defend its resources and uphold contractual integrity.
Dr. Adedokun described the ruling as a landmark in public sector technology contracting, highlighting that Nigeria is the first African country to defeat European Dynamics in arbitration. He emphasized that the outcome underscores the importance of rigorous UAT, clear milestone definitions, and strong institutional support in government technology projects.
