NICN Awards ₦20m Damages Against Ladox Limited for Workplace Injury

The National Industrial Court of Nigeria (NICN), Ibadan Judicial Division, presided over by Hon. Justice Dele Peters, has awarded the sum of ₦20 million in favour of Mr. Gbenga against Ladox Limited for injuries and permanent disability sustained in the course of his employment, arising from the company’s negligence.

The claimant, Mr. Gbenga, alleged that while operating a faulty machine at Ladox Plastics Product Ltd, he suffered a severe workplace accident. He contended that the machine suddenly restarted while he was attempting repairs, causing him grievous injury. He further averred that:

– At the time 200 Stars Resources took over Ladox Plastics, the company owed him over ₦1 million in salary arrears.

– Ladox Limited initially paid part of his medical expenses in Nigeria, but his subsequent treatment abroad was funded by a private individual.

– Despite reminders, the company only advanced ₦100,000 and failed to provide adequate support for his treatment or welfare.

The 1st Defendant, 200 Stars Resources, argued that it merely purchased a division of Ladox Plastics (factory and building) and did not assume liabilities. It maintained that Gbenga’s injury predated its acquisition and that it neither employed him nor owed him compensation.

Counsel for the claimant, A.A. Ibitara Esq, argued that the evidence of workplace injury was unchallenged and that the injury was directly linked to the negligence of Ladox Limited. Defence counsel urged the court to dismiss the claim against 200 Stars Resources, insisting that Ladox Limited was the proper employer.

In a considered judgment, Justice Peters:
