Jigsimur Plus Slams ₦100bn Lawsuit on Cleansimur for Alleged Trademark and Design Infringement

Jigsimur Plus Nigeria Limited has instituted a ₦100 billion lawsuit against Cleansimur International Limited over alleged counterfeiting and unlawful imitation of its registered herbal supplement’s patent, label, and bottle design. The company contends that Cleansimur’s actions amount to intellectual property theft and unfair competition in Nigeria’s herbal health industry.

The suit was filed at the Federal High Court, Lagos, in Suit No: FHC/CS/19525, by Jigsimur Plus Nigeria Limited, a subsidiary of JIGSIMUR SA ORIGINAL (PTY) LTD, the duly registered South African producer of the original JIGSIMUR SA ORIGINAL‑Y61977 herbal products. The company is represented by Chief (Sir) Ifeanyi Ejiofor, Esq., of I.C. Ejiofor & Co.

In a statement issued on 29 September 2025, Ejiofor described the action as a decisive legal step to safeguard Jigsimur’s intellectual and industrial property rights. He alleged that Cleansimur International deliberately adopted a name strikingly similar to Jigsimur and copied its registered bottle design, label, and brand inscription, thereby misleading consumers and unlawfully exploiting Jigsimur’s reputation and market share.

According to the statement, this alleged act of passing off has caused grave confusion among consumers, substantial reputational damage, and colossal financial losses to Jigsimur Plus Nigeria Limited. The company is therefore seeking ₦100 billion in general, exemplary, and aggravated damages for injury to its goodwill, reputation, and market position.

Jigsimur Plus is also asking the court for far‑reaching remedies, including declarations that Cleansimur’s use of the infringing name, label, and bottle design constitutes a violation of its registered patents and designs, amounting to unfair competition, unlawful misrepresentation, and injurious falsehood. The company further seeks a perpetual injunction restraining Cleansimur, its agents, distributors, and affiliates from further infringement or passing off counterfeit products in Nigeria.

Additionally, the claimant is requesting orders compelling regulatory agencies such as NAFDAC, SON, and the Federal Ministry of Industry, Trade and Investment to seize, impound, and destroy all infringing Cleansimur products across Nigerian markets, warehouses, and online platforms. It is also demanding ₦200 million in special damages for litigation and enforcement costs, alongside post‑judgment interest until full satisfaction of the judgment.

Ejiofor emphasized that the suit underscores Jigsimur Plus Nigeria Limited’s unwavering commitment to protecting its intellectual property and brand integrity. He added that it serves as a stern warning to counterfeiters and impostors seeking to exploit consumer trust in Nigeria’s rapidly expanding herbal health sector. The case has been filed and is currently awaiting formal assignment to a trial court.
