Court Throws Out FHT Mega Express Case, Labels Action Abuse of Process in Parallex Bank Dispute

The Lagos State High Court, Ikeja Judicial Division, presided over by Justice A.T. Muyideen, has struck out the suit filed by FHT Mega Express Limited against Parallex Bank and directed the claimant to publish the court’s decision in three national newspapers, as reflected in the Certified True Copy (CTC) of the judgment.

In the ruling delivered on 18 November 2025, the court terminated Suit No. LD/ADR/6143/2025, wherein FHT Mega Express alleged indebtedness on the part of Parallex Bank. The claimant had initially sought ex‑parte orders to attach the bank’s funds, but the court declined and ordered proper service on the defendant.

Upon service, Parallex Bank, represented by Dr. Kemi Pinheiro, SAN, filed multiple processes, including a preliminary objection dated 17 November 2025, contending that the suit constituted an abuse of court process.

The CTC further reveals that Parallex Bank had earlier instituted Suit No. FHC/L/CS/1774/2025 at the Federal High Court on 4 September 2025 against FHT Mega Express, seeking recovery of over ₦4.5 billion allegedly owed by the company. The Federal High Court had ordered parties to maintain the status quo, a fact FHT Mega Express failed to disclose before commencing the Lagos High Court action.

Confronted with the objection and its failed ex‑parte application, FHT Mega Express on 18 November 2025 applied to discontinue the matter, leading to the court’s order striking out the suit.
