American Musician Michael Smith Sentenced to 18 Months for $8M AI Music Streaming Fraud

American musician Michael Smith has been sentenced to 18 months in prison for using automated bots to inflate music streaming figures and fraudulently collect approximately $8 million in royalties from AI generated songs.

Smith was sentenced by a federal court in Manhattan on October 6, 2026, after pleading guilty in March to conspiracy to commit wire fraud. Prosecutors said he deployed automated bots between 2017 and 2024 to generate millions of artificial streams, boosting the play counts of songs created using artificial intelligence and earning royalties from the fraudulent activity.

As part of his plea agreement, Smith agreed to forfeit $8 million. He will also serve two years of supervised release after completing his prison sentence. Prosecutors had sought a 46 month prison term, while his lawyers requested probation, but the judge ultimately imposed an 18 month sentence.

During the sentencing, Smith, a father of six, became emotional and admitted that his actions had betrayed the music community. He told the court that he had failed miserably by committing the crime.
