The Federal Government has officially inaugurated the Advertising Offences Tribunal, a pivotal new adjudicatory body designed to significantly enhance regulation, professional standards, and accountability within Nigeria’s advertising and marketing communications sector. This development signals a robust commitment to enforcing compliance with the Advertising Regulatory Council of Nigeria (ARCON) Act 2022.
The tribunal was formally established on Tuesday in Abuja by the Minister of Information and National Orientation, Mohammed Idris. He underscored that the ARCON Act No. 23 of 2022 not only expanded the regulatory purview of ARCON but also necessitated the creation of this specialised tribunal to adjudicate offences stemming from breaches of the Act, associated regulations, and industry codes.
Minister Idris hailed the inauguration as a landmark achievement in the pursuit of a more professional, ethical, and responsible advertising landscape. He urged the tribunal members, led by Honourable Justice Cecilia M. A. Olatoregun, to execute their duties with unwavering fairness, independence, and integrity. “Every matter that comes before you should be considered on its merits, without fear or favour, affection or ill will. The Tribunal must be, and must be seen to be, a fair and impartial institution,” Idris stated, envisioning an industry that “commands creativity, earns trust, and upholds responsibility.”
Dr. Olalekan Fadolapo, Director-General of ARCON, described the tribunal as a groundbreaking initiative, noting it is the first of its kind globally. He highlighted its significance as a demonstration of Nigeria’s proactive approach to not only legislating advertising standards but also establishing concrete institutional frameworks for enforcement and dispute resolution. This tribunal represents a substantial opportunity for the Nigerian advertising industry, positioning it as a leader in regulatory innovation.
Justice Olatoregun, accepting the mantle of leadership, pledged that the tribunal members would uphold their responsibilities with professionalism, impartiality, and dedication. She affirmed their commitment to serving the nation with integrity. The tribunal’s membership also includes Musa Ahmed Attah (SAN), Merga Tyowanan Kachina Esq., Dr. Ken Onyeali Ikpe, and Hajia Sa’a Ibrahim.
Established as an independent, specialised judicial body under the ARCON Act, the tribunal is mandated to ensure fairness, transparency, and the swift resolution of disputes and offences related to advertising practices in Nigeria. Its operational focus will be on the speedy hearing and timely determination of all cases brought before it.
This crucial step follows ARCON’s recent implementation of mandatory vetting for social media advertisements and the requirement for online content creators, including influencers and bloggers, to secure regulatory approval before promoting products and services. The heightened regulatory oversight by ARCON is driven by the imperative to safeguard consumers, elevate industry standards, and curtail the prevalence of unvetted advertisements across digital platforms. This tribunal’s establishment is therefore critical for legal counsel, compliance officers, and corporate executives navigating the evolving advertising landscape.
