Texas AG Launches Sweeping Probe into “Heart-Healthy” Food Labeling Amid Deceptive Practices Allegations

Texas Attorney General Ken Paxton has initiated a significant investigation targeting major food manufacturers accused of misleading consumers with “heart-healthy” product labels. The probe, which has already issued Civil Investigative Demands (CIDs) to prominent companies, centres on allegations that these labels are applied to products laden with added sugars, refined grains, and inflammatory ingredients, thereby potentially violating the Texas Deceptive Trade Practices Act (DTPA).

Companies currently under scrutiny include Frito Lay, Flora Food Group, and ACH Foods. The Attorney General’s office is examining whether the advertising practices of these manufacturers constitute misrepresentation of product health benefits to Texas consumers. Attorney General Paxton expressed a firm stance against what he perceives as corporate attempts to market unhealthy food items, stating, “I won’t allow corporations to slap a ‘heart healthy’ symbol on their food labels as an attempt to market seed oils and other chemical-filled foods as healthy.”

The investigation highlights a common industry tactic where labels may emphasize the absence of one “bad” ingredient, such as low cholesterol or sodium content, while obscuring the presence of other detrimental components. This strategy, according to the Attorney General’s office, can be notoriously misleading. Specific products named in the probe include Mazola Canola Oil and Sun Chips, cited for their high omega-6 fatty acid content, which has been linked to increased risks of obesity, inflammation, cardiovascular disease, cancer, and autoimmune diseases.
