Burkina Faso Enacts Landmark Religious Freedom Law, Bolstering Public Order and Transparency
In a significant legislative development, the People’s Legislative Assembly (ALP) of Burkina Faso has unanimously adopted a comprehensive draft law governing religious freedoms. The 112-article legislation, divided into six titles, aims to harmonise the exercise of religious liberties with the imperative of maintaining public order, fostering social cohesion, and promoting harmonious coexistence within the nation.
The newly enacted law establishes fundamental principles for the practice of religion across Burkina Faso, explicitly reaffirming freedom of conscience, belief, and worship. This framework is designed to align with the nation’s core values of peace and tolerance.
A key component of the legislation addresses the establishment and operation of religious buildings and places of worship, outlining specific conditions for their creation and functioning. This measure seeks to ensure a more organised approach to religious activities, consistent with existing legal frameworks. Furthermore, the law introduces clear regulations for cultic and religious activities, promoting responsible religious practice that respects national security, social peace, and the general interest.
In a move designed to enhance accountability, the law introduces mechanisms for greater transparency in the mobilisation and management of financial resources by religious organisations. While preserving their operational autonomy, these provisions aim to strengthen oversight of financial dealings within religious structures.
To ensure adherence to the new provisions, a system of sanctions has been established for instances of non-compliance or offences. These measures are intended to guarantee the effective application of the law and to prevent any actions that could jeopardise public order or national unity.
The law also includes transitional and final provisions detailing its entry into force and the necessary accompanying measures for its implementation.
Minister of State and Minister of Territorial Administration and Mobility, Comrade Emile ZERBO, hailed the adoption of the law as a modern text well-suited to Burkina Faso’s current realities. He noted that the legislation fills a long-standing legal vacuum in the regulation of religious matters, enabling the state to better address issues related to religious practice, public order, and the counteraction of extremist abuses. “The text now allows the State to better take into account the issues related to religious practice, the preservation of public order, and the fight against extremist abuses. We have reached an important milestone in the life of our Nation,” stated Comrade ZERBO.
Comrade ZERBO further elaborated that the new law is expected to play a crucial role in preventing religious radicalism, regulating the activities of preachers, and sanitising the use of public spaces for religious purposes. He also underscored the law’s commitment to protecting vulnerable individuals from religious exploitation, specifically citing the issue of forced begging among children, which will not be justifiable under any religious pretext. Awareness campaigns, including translations into national languages and discussion forums, are planned to ensure widespread understanding of the new legislation among religious communities and the general populace.
This legislative reform signifies Burkina Faso’s commitment to balancing the protection of religious freedoms with the critical needs for stability, security, and social cohesion. The reform is anticipated to bolster interreligious dialogue, peaceful coexistence, and national unity amidst a challenging geopolitical landscape.
