NBA’s New MCPD Rules: What Every Nigerian Lawyer Needs to Know—Now

For lawyers who frequently use the Nigerian Bar Association (NBA) stamp and seal in court, the new NBA policy on Mandatory Continuing Professional Development (MCPD) carries immediate consequences. Under the MCPD Rules, every lawyer must complete at least 5 Continuing Professional Development (CPD) hours to qualify for practice licence renewal.

The new MCPD Rules issued through the NBA Institute of Continuing Legal Education (NBA-ICLE) are effective immediately. The NBA-ICLE will also accredit programmes that qualify for CPD points.

Approved at the recent National Executive Committee (NEC) Meeting in Akure, the MCPD Rules significantly change legal practice and regulation in Nigeria, and have implications for every lawyer’s professional reputation.

What’s Changed? The 5-Hour Rule

Every lawyer must now clock a minimum of 5 CPD hours annually—and not just any hours. These must be from NBA-ICLE-accredited programmes that focus on legal practice, ethics, and professional development. Random webinars don’t count, unless they are NBA-ICLE-approved.

No CPD—No Licence, No Stamp

Since the stamp and seal are essential for authenticating legal documents filed in court and for issuing official letters, losing access effectively prevents these lawyers from performing key aspects of their litigation practice. Without a valid stamp and seal, court filings may be rejected as unauthenticated, and solicitors cannot properly certify documents, putting their entire practice at risk.

Solicitors, Don’t Get Too Comfortable

For those who might think, “Well, I’m a solicitor, I don’t use the stamp and seal as often.” Not so fast. The NBA will now publish an annual list of both compliant and non-compliant lawyers. Imagine a client Googling your name and finding you on the “non-compliant” list. That could be very bad for business.

The Big Question: How Will Practice Licence Verification Work?

The NBA has transitioned to a digital stamp and seal system designed to enhance security and reduce forgery. This digital system stores seals securely and requires proper handling of data to maintain integrity.

However, the NBA hasn’t yet clarified how it will verify each lawyer’s practice licence remains valid or has been renewed each year. It waits to be seen if the NBA will constitute an enforcement team to visit courtrooms and offices to confirm each lawyer’s compliance with the MCPD Rules or simply rely on the hope of deterrence through the publication of the non-compliant list.
